1. Acceptance of terms

By creating an account or using BuyerSafeCart (buyersafecart.com), you agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use BuyerSafeCart.

These terms apply to all users — buyers, sellers, affiliates, and visitors.

2. What BuyerSafeCart does

BuyerSafeCart is an escrow-based commerce platform that connects buyers and sellers in Nigeria. We hold buyer payments securely until the buyer confirms delivery. We are not a party to the sale — we facilitate the transaction between buyer and seller.

3. Accounts

• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for keeping your password secure
• You may not create multiple accounts or share account access
• We reserve the right to suspend accounts that violate these terms

4. Seller obligations

• Complete KYC Level 2 (NIN + Government ID + Bank account) before listing products
• Only list items you actually have in stock and can deliver
• Ship within 24 hours of receiving a paid order (or within agreed timeframe)
• Provide accurate product descriptions, images, and pricing
• Not list counterfeit, stolen, or prohibited goods
• Respond to buyer messages within 24 hours
• Accept our platform commission: 5% (Free), 4.5% (Basic), 3.5% (Pro)

Sellers who receive 3 or more disputes in 30 days may be suspended pending review.

5. Buyer obligations

• Provide an accurate delivery address
• Make payment promptly after placing an order
• Confirm delivery honestly — only confirm if you've received your order
• Raise disputes within the 5-day escrow window if there is a problem
• Not abuse the dispute system to delay legitimate payments to sellers

6. Payments and fees

What buyers pay

• Product price (as listed by seller)
• Paystack processing fee: 1.5% of order + ₦100 (capped at ₦2,000)
• VAT on Paystack fee: 7.5% of the Paystack fee
• Stamp duty: ₦50 on orders above ₦10,000 (required by Nigerian law)

What sellers receive

Product price minus BuyerSafeCart's platform commission (5%, 4.5%, or 3.5% depending on plan). Paystack fees are absorbed by the buyer — sellers receive the full listed price minus only the platform commission.

Refunds

Refunds are issued to buyers when: (a) a dispute is resolved in the buyer's favour, (b) a seller cancels an order, or (c) BuyerSafeCart determines a refund is appropriate. Paystack fees may not be refunded in all cases.

7. Escrow system

All payments are held in BuyerSafeCart's escrow account powered by Paystack. Funds are released to the seller when:

• The buyer confirms delivery via the dashboard or WhatsApp (CONFIRM command)
• 5 days pass after the order is marked "Shipped" with no dispute raised (auto-release)

Funds are held (and potentially refunded to buyer) when:

• A dispute is opened before the 5-day auto-release
• BuyerSafeCart determines the seller violated these terms
• Law enforcement or court order requires us to hold or return funds

8. Disputes

Buyers may raise a dispute within 5 days of an order being marked "Shipped" by replying DISPUTE [tracking number] on WhatsApp or using the dispute button on their dashboard.

BuyerSafeCart will investigate disputes and may request evidence (photos, videos, correspondence) from both parties. Our decision is final.

Abuse of the dispute system (raising false disputes repeatedly) may result in account suspension.

9. Trust scores

Every seller has a trust score (0–100) calculated automatically from delivery performance, customer ratings, speed, and cancellation rate. Sellers who complete KYC Level 2 start at a base score of 60.

Trust scores are publicly visible. BuyerSafeCart is not liable for any commercial impact of a seller's trust score.

10. Prohibited items

The following are strictly prohibited on BuyerSafeCart:

• Counterfeit or replica goods of any kind
• Stolen property
• Weapons, firearms, ammunition
• Controlled substances or drugs
• Pornographic or adult content
• Human trafficking or related services
• Financial instruments or currencies (forex, crypto trading services)
• Anything illegal under Nigerian law

Listing prohibited items will result in immediate account termination and may be reported to relevant authorities.

11. Affiliate program

Affiliates earn commission on sales generated through their referral links. Commission rates are: Bronze 3%, Silver 4%, Gold 5%, Platinum 7%.

Commissions are paid 7 days after buyer delivery confirmation. BuyerSafeCart reserves the right to withhold commissions from fraudulent referrals or cancelled/refunded orders. Minimum payout is ₦5,000.

12. Termination

BuyerSafeCart may suspend or terminate your account at any time for:

• Violation of these terms
• Fraudulent activity
• Chargebacks or payment fraud
• Multiple unresolved disputes
• Inactivity for more than 12 months

You may close your account at any time by contacting us. Pending escrow funds will be released according to their normal timeline before account closure is completed.

13. Limitation of liability

BuyerSafeCart is a marketplace platform. We are not responsible for:

• The quality, accuracy, or legality of items listed by sellers
• Seller failure to deliver (though our escrow protects buyers)
• Losses arising from force majeure events
• Third-party service failures (Paystack, WhatsApp, delivery carriers)

Our total liability in any dispute shall not exceed the amount of the transaction in question.

14. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the jurisdiction of Nigerian courts. We encourage amicable resolution before pursuing legal action.
